They Be Hatin the OPD

My title is from a musician who sings the NYPD “they be hatin”. On a daily basis good Officer’s encounter radical extreme activists who hate the police.   No matter how professional we are, no matter what illegal or unlawful behavior they have factually committed, Police are “harrasing” them because of their skin color. Every event is “racial profilling”, nothing has to do with their illegal, unlawful, behavior its police bias. This argument is losing ground as police agencies especially here in NYC become more diverse. They also influence impressionable young persons to develop the same vitriolic hate.  They encourage aggressive anti social behavior and will often suggest that you are a man ” a warrior” a solider if you get arrested or induce the police to do the same. Even in the midst of a cop killing spree in Oakland this week, they attempt to make the dead officers escape goats.

is presenting a video in which many activists endorse the recent cop killer Lovelle Mixon’s gunning down of four Oakland Police Officers. The video speaks for itself its pure hate speech. It condones extreme violence and does nothing to foster harmony.  Sad but true and alot of folks harbor similar hatred.

Strange ,Bizarre but so New York, the New York Daily News http://www.nydailynews.com/money/2009/03/26/2009-03-26_soho_sm_club_owners_donald_macpherson_an-1.html is reporting that an  S and M club in N.Y.C. utilized it’s  S and M customers ( data base)  to obtain phony mortgages in another housing fraud incident. They ran an event called the black and blue ball ( http://theblackandblueball.com/bbbindex.php/bbb/index/ )

Caloric Entrapement

The La Times http://latimesblogs.latimes.com/sports_blog/2009/03/minor-league-te.html is reporting that a minor league baseball team is going to feature a  4800 calorie burger at it’s concessions.

burgerMajor League Baseball http://mlb.mlb.com/index.jsp is in the sports industry, and it’s product is men who are for the most part in impeccable condition.  Yes, people have free will, yes people should be self disciplined, but my god if this isn’t self destructive eating I don’t know what is. Worse this thing takes on a ” I bet you can’t eat it mentality”  to many of the fans to whom beers , baseball and brawls is a summer ritual.

The American Heart Association http://www.americanheart.org/presenter.jhtml?identifier=3040447 gives some useful rules regarding caloric intake, and how many foods we eat are void of nutrients.   As with speeding over the limit, you do so at your own risk of a traffic ticket or a serious accident in which you risk serious injury or death.

We seem to permit, allow, market and encourage reckless behavior.  Reckless has been defined as ” heedless to the consequences” see http://legal-dictionary.thefreedictionary.com/reckless

So, in my opinion if you gulp down  this $20.00 burger you are reckless to your health , and that a major league baseball affiliate is promoting same is offensive.

Today, got up had my orange juice, vitamins ,made my coffee and cooked my Irish Oatmeal. First a fact :  Oakland has a homicide rate nearly 5 times the national average, and as crime decreased the last decade this City had an increase. http://www.rand.org/pubs/working_papers/2004/RAND_WR129.pdf

Here is the first official version:  “Sergeants Daniel Sakai and Ervin Romans, SWAT team members, were killed when they attempted to apprehend a suspect that had earlier in the day, killed Sergeant Mark Dunakin during a traffic stop.

At about 1:15 pm, two motorcycle officers tried to pull over a car on a traffic stop at 74th Avenue and MacArthur Boulevard, when the driver opened fire, killing Sergeant Dunakin and gravely wounding the second officer. The gunman then fled on foot, leading to an intense manhunt by dozens of Oakland police, California Highway Patrol officers, and Alameda County sheriff deputies.

At about 3:30 pm, after receiving an anonymous tip, the suspect was located barricaded inside an apartment building. The gunman fired an assault rifle at officers who came into the building to arrest him. Sergeants Ervin Romans and Daniel Sakai of the SWAT team were killed and a third officer was grazed by a bullet. Police returned fire, killing the 26-year-old male suspect, who was wanted for violating his parole after a conviction for assault with a deadly weapon.”

Issues:  95 % OF CALIFORNIA OFFENDERS ARE ON PAROLE! UN -REAL!

1. NPR is already stating ” tensions with the police are high” due to a past shooting ( and tragic death of an unarmed African American man by “BART” Police Officers . This comparison is a defacto justification ” police cause tension”, and it assumes the part of the causation is public  anxiety caused by the Police. How about tension caused by drug dealers, pimps, robber’s, burglars, gangs and other assorted deviates who break the law, and are paroled by political hacks. This spin in light of 4 dead cops is evidence that the media is biased and pre-judgmental in reporting about law enforcement.

2. The shooter is a parole, and he was armed with an assault weapon.  Do you really, really think Parole works, do you really really think think this is an isolated incident a parole with a gun. No, the only reason you read about it is that Cops were killed.

3. Police “critics” are already demanding to know ” what was the traffic stop for”. Well as the Officer’s are dead, we may never know, but it will raised the defensed of ” racial profiling”. Police must always defend and justify their actions.

4. God rest these brave men, and my sincere condolences to their families.

Frequently all of us in a free democracy debate what “rights” we as individuals have and whether the public good outweighs the private right.  In Schenck v united States ( see http://law.jrank.org/pages/12613/Schenck-v-United-States.html)  Justice Holmes clearly defined this balance when writting  about the 1st Amendment and unprotected  Freedom of Speech, when he stated the right of free speech is not absolute, as one cannot yell ” fire” in a crowded theater. In this case an Officer who served in the Bellevue Department was reported to be unfit  by his fellow Officers during a training exercise . See http://www.omaha.com/index.php?u_page=2798&u_sid=10588900 Apparently he was suppose to maintain a “high” level of physical, mental and emotional conditioning. However, citing the Departmental written guidelines he was only required to be in “fair” levels of physical, mental and emotional conditioning.  Apparently after twenty five years of service the officer had let his body fall apart.  The court accepted  the “fair” standard as opposed to the “high” standard and I imagine the attorney’s had a field day as both terms have subjective meaning opening the door to a colloquy on said words.

dunkin-donut-cops1This is another example of the late great Democrat Senator from New York Patrick Moynihan described as  defining deviancy downward.  ( See http://www2.sunysuffolk.edu/formans/DefiningDeviancy.htm) We know longer legally see an obese person as physically incapable of performing strenuous activity,incapable of performing the physical skill set required of a police officer ( run quickly, dexterity,climb scares, run over or jump over fixed objects (  e.g. fence wall ) strength ( fight overcome a violent criminal, lift remove a person from a car accident). 

Here the court rules Police Officer’s need only perform at a  ”fair ” level. As such the court permits acceptable levels of police service to deteriorate. ( Think merit pay for teachers)   As such the public is placed at a risk, as the officer might not be able to help you and do so at your time of urgency, when you need someone who can move quickly with the aforementioned skill set.  ( Think reasonable high physical skills to remove a person from a car or home on fire) 

In doing so the court as here validates a higher ” private ” right” as  opposed to ruling that tax payers have a right for officers to maintain “high” standards”.   This is a classic example of expanding “private” rights outweighing” public rights. Senator Moynihan would not be surprised as  we no longer have parasictic  status to deviant behavior. We have ” social correctness and understanding.  Who loses, we all do stereotypical ” dun kin donuts cops ” have a right to consume unhealthy diets. Teachers, need only perform at ” fair levels” think low math scores.   Sad and scary facts that are eroding the American template of excellence.

Nassau County Police that are reporting an African American  man  Daryl Jackson was assaulted by individuals who eschewed derogatory racial hate speech at him during the attack.  The victim an African American man stated his attackers shouted ” go back to Africa”. Let’s pray he recovers from this attack, but when four men beat you for a period of time and you are 52 years of age, the injuries and psychological scars may last forever.

The reports and sources are now saying an off duty member of the NYPD  ( pictured above) may have particpated in this possible “bias” incident. To be labeled and charged as “bias” investigators must determine if the crime was motivated by racial animus. That he himself was Latino, indicates that any individual can be racist even if they themselves belong to a traditional minority group.

Telling on this guy, is that newspapers reports he owns a 2009 Camry, a Hummer and a Denali. Owning such expense cars certianly is circumstantial evidence of extraordinary income far and above the payscale of the average officer.

Today Reuters reports about the ingenuity of drug traffickers. In this case it appears a Chilean man had his leg broken on purpose. Afterwards they fashioned a cast made out of pure cocaine. Recession Hits Police Departments

Clearly as the state tax revenues decline municipal workers will feel the effects, however if the recession correlates with an increase in crime  cut backs in enforcment may accelrate the problem.  Many municipal police agencies are in fact attesting to this noting that “property crimes” have increased during the current recession. Lately in the Bronx, I have seen an uptick in criminal mischief to motor vehicles ( stealing side view mirrors). They break the mirror off and sell them to glass, window, and mirror replacement business.  This is also occuring in Suburbia see ( http://www.wcbs880.com/Thieves-Taking-Side-View-Mirrors/1430335)

With so many unknowns and so many uncertainties surrounding the future economy, it only seems to make sense that as the public  unemployment increases, frustration and anxiety build up, it will result in an increased workload for Police Departments.

NYPD OFFICERS ACCUSED OF RAPE

News papers are reporting that an NYPD Officer raped an intoxicated women after escorting her to her residence from a drinking establishment. See http://www.nypost.com/seven/03042009/news/regionalnews/partner_turns_on_accused_rape_cop_157926.htm

The accounts are horrific and the actions of the officers if prov-en to be true are a gross deviation from their sworn duty, and tarnish the entire police department. Police are often in situations where the public “trusts” us in their most vulnerable moments. That this trust is violated, in a brutal rape against a defenseless women who was incapacitated is an extremely violent crime.

That a police officer may have committed the offense is a betrayal of the public trust of the highest order. As such and if and when the Officer’s are convicted they  deserves life without parole. It will be years before the public trust is established.

That his partner ( if true) stood guard, and facilitated the crime makes him a full accessory to rape. No special treatment should be given to these officers who are in fact savages, if and when a court of competent jurisdiction finds them guilty. As even police are entitled to a fact finding court adjudication of the incident.

Morally, that a Police Officer who has seen the carnage of crime, and seen the tears of victims becomes a predator indicates that he may have been a bad apple all along. As such all his prior cases and all offenses in which he was the arresting officer are suspect and may have been tainted.

It is also being reported that Officer Moreno had Heroin in his Locker. Generally, this indicates a drug addict, and rogue officer. The police department is no different than any other large organization. We have good, and bad, loving and indifferent. But this guy takes the cake, a rapist with a gun and shield who preyed upon an unsuspecting female in need of safe passage to her home. She would up with a wolf in sheeps clothing, and if this is true Kenneth Moreno and his partner should never see the streets of New York again.

Today the New York Post http://www.nypost.com/seven/03022009/news/columnists/city_cops_baddy_buddies_157607.htm is reporting about members of the NYPD who are associating with known criminals.

This is a real issue for the Police Department. As many younger officer have maintained relationships including intimate ones with known felons. Frequently especially in intimate relationships the dominant role ” controlling ” person may be the felon. In a recent case an officer was laundering money for her boy friend. What many Officers do is to ” keep it real ” with their childhood neighborhood friends”. When they become Police Officer’s they fail to sever the relationship.  In fact many are sympathetic and or indifferent to low level drug sales by their friends. They don’t see the hypocritical relationship by ” hanging” with these individuals. So they may not be present during the illegal behavior, but will have social relationship with the criminals.  Clearly an ethical conflict, and one that is not condoned by the NYPD policy, or by the sworn oath to uphold the U.S. and State Constitution.

In Mexico http://www.latimes.com/news/nationworld/world/la-fg-mexbust28-2008oct28,0,3196498.story officials have admitted that drug cartels have infiltrated police operations.  All across America Police Agencies, have to conduct investigations ” background checks” on applicants. However no system is fool proof.

In N.Y. the starting salary for Officers’ dropped to about $ 27,000.00. In an effort to maintain staffing levels, it is gossip in the NYPD that many persons who would not have been police officer’s in the past were hired. For example a person charged with Grand Larceny Auto( a felony)  but had the charges dropped to disorderly conduct ( a violation ) would be qualified to be hired as they had never been ” convicted” of a felony, only arrested for same.
